Terms and Conditions for The Client Spotlight Drawing
The following terms and conditions (the "Terms") govern your participation in The Client Spotlight Drawing ("the Drawing"), a competition to win up to $500 in charitable donations to a charity of your choice. By entering the Drawing, you agree to be bound by these Terms and all applicable laws and regulations. Please read these Terms carefully before entering.
1. Eligibility
1.1 Participation in the Drawing is open to all clients of Tricia Charles Photography.
1.2 You must be 18 years of age or older to participate.
1.3 Employees, contractors, and immediate family members of Tricia Charles Photography are not eligible to participate.
2. How to Enter
2.1 To enter the Drawing, you must take a photograph or selfie of yourself holding up your photographic products purchased from Tricia Charles Photography after your reveal session.
2.2 No Purchase Necessary: No purchase is necessary to enter or win the Drawing. To enter without purchasing a product, you may submit your name, email, and a photo of yourself holding your favorite image taken by Tricia Charles Photography via email to hello@triciacharlesphotos.com.
2.3 Only one entry per person will be accepted.
2.4 By submitting your photograph or selfie, you grant Tricia Charles Photography permission to use the image for promotional purposes related to the Drawing, including on social media and in marketing materials.
3. Opting Out
3.1 Opting Out: Participation in the Drawing is voluntary. You may choose to opt out of the Drawing at any time by notifying Tricia Charles Photography in writing (via email or other methods of contact).
3.2 If you opt out, you will not be entered into the drawing for the charitable donation prize.
4. Prize Details
4.1 Prize Description: The winner of the Drawing will receive a charitable donation of up to $500 to a registered charity of their choice.
The charity must be a registered nonprofit or tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code.
The donation will be made directly to the charity, not to the winner personally.
4.2 The prize is non-transferable and may not be redeemed for cash or any other alternative form of payment or reward.
4.3 The Drawing is not a raffle and will be conducted as a random drawing of all eligible participants.
5. Winner Selection and Notification
5.1 The winner will be randomly selected from all eligible entries. All entries will be placed into a random drawing pool, and the winner will be chosen by a fair and unbiased drawing process.
5.2 The drawing will take place every 12 months, and the winner will be contacted via the contact information provided during their initial session.
5.3 Notification: The winner will be notified via email or phone within 14 days of the drawing. If the winner does not respond within 14 days of being notified, they forfeit the prize, and another winner may be selected.
5.4 Public Announcement: The winner agrees to allow Tricia Charles Photography to announce their name and selected charity for promotional purposes, including on social media and in any other marketing materials.
6. Liability
6.1 No Liability: Tricia Charles Photography is not responsible for any technical failures, system malfunctions, or interruptions that may occur during the entry process, including but not limited to website errors, email issues, or lost submissions.
6.2 By entering the Drawing, you release Tricia Charles Photography, its affiliates, and their respective directors, employees, and agents from any and all liability, including any injuries, damages, or loss of any kind resulting from participation in the Drawing or from receiving the prize.
7. Personal Data
7.1 Collection of Data: By entering the Drawing, you agree to the collection and use of your personal data in accordance with Tricia Charles Photography's Privacy Policy.
7.2 Your personal data will only be used for the purpose of administering the Drawing and may be shared with third parties only for that purpose (e.g., charitable donation processing).
8. General Conditions
8.1 Drawing Modifications: Tricia Charles Photography reserves the right to cancel or modify the Drawing at any time, including due to technical issues, fraud, or other unforeseen circumstances.
8.2 Amendments to Terms: These Terms may be updated by Tricia Charles Photography at any time, with or without notice. Continued participation in the Drawing constitutes your acceptance of any changes made to the Terms.
8.3 Governing Law: These Terms are governed by the laws of the Commonwealth of Massachusetts. Any disputes arising from or related to the Drawing will be resolved under Massachusetts law and within its courts.
